What's Inside

The first 5 of 11 steps

  1. Use the deemed-receipt rule for your service method. If the tenant actually got the notice sooner, the actual date counts.
  2. The last day to pay in full or dispute is 5 days after receipt.Section 46 says 5 days, not 5 business days.
  3. The effective date must be at least 10 days after receipt. If it is too early, section 53 moves it to the earliest date that complies.
  4. If a deadline falls on a weekend or holiday, confirm the date with the RTB before relying on any extra day.
  5. Check your payment records.Only full payment of the overdue amount within 5 days cancels the notice. A partial payment does not.
