What's Inside
The first 5 of 15 steps
- Good faith, with every permit and approval the law requires already in place. They must cover the work that needs vacancy. With no permit needed, bring written proof such as municipal confirmation or an engineer's report. Get strata approval first if a bylaw requires it.
- The work requires the unit to be vacant (empty).Faster, cheaper or easier with the unit empty is not enough.
- The work is necessary to prolong or sustain the use of the unit or building.Cosmetic updates aimed at décor or prestige are rarely enough.
- Ending the tenancy is the only reasonable way to get the vacancy. If the work needing vacancy takes 45 days or less and the tenant will live elsewhere and give access, the tenancy generally should not need to end.
- Renovation or repair: apply to the RTB under section 49.2.Do not serve a notice. An RTB-29 used for renovation work is the wrong route.
